I ordered an iPhone 16 Plus that was expected to arrive on October 29. The tracking showed it was in my city on the West Coast that morning, but then it switched to showing it was in New Jersey, and now it's been stuck there with no updates. I never actually received the phone. After contacting Apple, they and UPS both claim it's still "out for delivery." Today, Apple emailed me saying they won't offer a replacement or refund, which seems unfair since I never got the phone. What are my options? Should I dispute the charge with my bank? I'm worried that Apple might ban my account if I do that.

Disputing the charge might sound tempting, but that could lead to consequences with Apple. They’re likely to ban your account and might even try to bill you for the phone. Just try to stick to your patience strategy for now!
First off, it sounds like you just need to be patient for a little while longer. UPS typically won't consider a package "lost" until it's been missing for at least 15 days, so Apple likely won't help until then. Just waiting it out seems to be the best option right now.
I get that it’s frustrating! I’ve had packages do the same thing before. I still think reaching out to UPS might give you more info, but it’s good to hold off a bit before pushing Apple too hard.
Honestly, it’s too soon to dispute the charge with your bank. Since the delivery window is still open, you’ll probably just end up with a bigger headache if you go that route. And yes, there's a chance Apple might take action against your account if you do that.

Totally agree. It's rough, but a bit of waiting could save you a lot of hassle. Apple's policies can be strict!
